Pornhub sotto la lente del Garante privacy
L’Autorità chiede chiarimenti su profilazione degli utenti e sistemi di tracciamento

Il Garante per la protezione dei dati personali ha chiesto informazioni a MG Freesites Ltd, la società cipriota che gestisce il sito Pornhub, riguardo alla versione italiana del sito. Diversi i profili sui quali l’Autorità intende fare luce, dopo il reclamo di un utente.

La società dovrà chiarire se effettua trattamenti di profilazione degli utenti e, in tal caso, con quali modalità e finalità. Per quanto riguarda l’uso di cookie e altri strumenti di tracciamento diversi da quelli tecnici, la società dovrà indicare la base giuridica del trattamento (sia per gli utenti che abbiano creato un account sulla piattaforma sia per quelli non autenticati), la tipologia e la natura dei dati eventualmente raccolti, nonché le modalità tecniche per raccogliere il consenso e quale informativa sia stata resa agli utenti.

MG Freesites dovrà inoltre chiarire se i dati raccolti siano comunicati a terzi, precisando gli eventuali destinatari e chiarendo se tale circostanza sia stata preventivamente resa nota agli utenti.

L’Autorità ha infine chiesto quali misure siano state adottate per verificare l’età anagrafica degli utenti e per consentire agli utenti l’esercizio dei diritti in materia di protezione dei dati personali.

La società ha 20 giorni per rispondere alle richieste dell’Autorità.

The Authority requests clarifications on user profiling and tracking systems

The Garante per la protezione dei dati personali (‘GPDP’) submitted a request for clarification to MG Freesites Ltd, the Cypriot company that manages the Pornhub site, regarding the Italian version of the site.  Further to a complaint lodged by a user, the Authority intends to shed light on a number of aspects of the processing. The company will have to clarify whether it carries out profiling of users, and, if so, by what means and for what purposes.

As regards the use of cookies and other tracking tools other than technical ones, the company will have to indicate the legal basis of the processing (both for users who have created an account on the platform and for unauthenticated ones), the type and nature of any data collected, as well as the technical methods for obtaining consent and what information has been provided to users.

MG Freesites will also have to clarify whether the data collected is communicated to third parties, specifying any recipients and clarifying whether this circumstance has been previously disclosed to users.

Lastly, the Authority asked what measures have been taken to verify the users’ age and to allow users to exercise their rights regarding the protection of personal data.

The company has 20 days to respond to the Authority's requests.
